MANUAL IN TERMS OF SECTION 51 OF THE PROMOTION OF ACCESS TO INFORMATION ACT, NO. 2 OF 2000 (PAIA)

INFORMATION IN TERMS OF SECTION 5 OF THE PROTECTION OF PERSONAL INFORMATION ACT, NO. 4 OF 2013 (POPIA)

1. Introduction


This Manual is published in terms of Section 51 of the Promotion of Access to Information Act, No. 2 of 2000 (“PAIA”). The aim of PAIA is to give effect to the constitutional right of access to any information held by any person, where such information is required for the exercise or protection of any rights.

This Manual also serves as an Information Guide in terms of Section 5 of the Protection of Personal Information Act, No. 4 of 2013 (“POPIA”). It is intended to assist persons who wish to exercise their right of access to information held by The Lineup Club and/or to understand how their personal information is processed.

3. Information and Designated Officers

4. Guide on How to Use PAIA

The South African Human Rights Commission (“SAHRC”) has compiled a guide containing information to assist a person wishing to exercise a right of access to information in terms of PAIA. This guide is available in all official languages.

5. Automatic Disclosure (Available Records Without a Formal Request)
The following categories of records are automatically available for inspection, either at our premises, on our website, or upon simple request, free of charge:

  • Our Privacy Policy (incorporating POPIA principles).

  • Marketing brochures and membership information packs.

  • Standard Terms and Conditions of Membership.

6. Records Available in Terms of Other Legislation (if applicable)
Where applicable, The Lineup Club retains records in accordance with the following legislation (non-exhaustive list):

  • The Companies Act, No. 71 of 2008 (e.g., Founding Documents, Minutes of Meetings).

  • The Concumer Protection Act, No. 68 of 2008 – for the interest of guests/members and fair trading practices.
  • The Financial Intelligence Centre Act, No. 38 of 2001 (FICA) – for member identification records.

  • The Value Added Tax Act, No. 89 of 1991. (*Currently not applicable)

  • The Income Tax Act, No. 58 of 1962.

  • The Basic Conditions of Employment Act, No. 75 of 1997.

  • The Occupational Health and Safety Act, No. 85 of 1993.

7. Subjects and Categories of Records Held by the Lineup Club

Records held by the Lineup Club are categorised as follows. Please note that access to many of these records may be subject to mandatory protections of third-party personal information, commercial confidentiality, or other grounds for refusal as outlined in PAIA.

8. Request Procedure and Form

8.1 How to Submit a Request:
A requester must complete the Form C Request for Access to Record (prescribed under PAIA Regulations) and submit it to the Information Officer at the contact details in Section 3. This form is available from the SAHRC website or from our Information Officer upon request.

8.2 Information Required in the Request:
The request must:

  • Provide sufficient particulars to enable the Information Officer to identify the record(s) and the requester.

  • Specify the form of access required (e.g., copy, inspection).

  • State if the request is for the requester’s own personal information (which has a different fee structure).

  • Specify a postal address, contact number and email in South Africa for correspondence.

8.3 Decision & Timeframes:
The Information Officer will, within 30 calendar days of receiving the request, decide whether to grant or decline it. This period may be extended by a further 30 days if necessary, and the requester will be notified of any extension with reasons.
If the request involves personal information of the requester, it will be processed under both PAIA and POPIA.

9. Fees (as per PAIA Regulations)

A requester is liable for the prescribed fees for searching, reproduction, and/or postage of records. The current prescribed fee structure is available from the SAHRC. A fee estimate will be provided to the requester before the request is processed. No fees are payable for:

  • A request for the requester’s own personal information, unless the preparation of the record requires substantial time, in which case a reasonable access fee may be charged.

  • The first hour of search/reproduction time for any other request.

10. Grounds for Refusal of Access

Access to a record may be refused on grounds outlined in Chapter 4 of PAIA, including, but not limited to:

  • Protection of personal information of a third party (unless consented to).

  • Protection of commercial information of a third party or Lineup Club (e.g., trade secrets).

  • Protection of confidential information supplied under a duty of confidence.

  • Privileged information (e.g., legal advice).

  • If the record contains research information of the Club or a third party that is yet to be published.

  • If disclosure could reasonably be expected to endanger the life or safety of an individual.

The Information Officer will provide adequate reasons for any refusal.

11. Remedies Available upon Refusal

If a request is refused, the requester will be informed of:

  • The reasons for the refusal.

  • Their right to lodge an internal appeal or an application with a court.

  • Their right to lodge a complaint with the Information Regulator (for matters involving personal information).
